Sample Pack License Agreement

By purchasing, downloading, accessing or using any sample pack, preset pack, sound pack or comparable digital content provided by Krach Entertainment GmbH, you agree to this License Agreement.

If you do not agree to these terms, or if you have not lawfully obtained the content through Krach Entertainment GmbH, its official online store or an authorized sales platform, you are not permitted to use the content — neither commercially nor non-commercially.


1. Definitions

“Sample Pack” means a collection of digital audio files, presets, MIDI files, loops, one-shots, FX, drum sounds, synth sounds, vocals, construction kits or other creative production content provided by Krach Entertainment GmbH.

“Samples” means individual audio files such as drum one-shots, synth one-shots, loops, vocal phrases, FX sounds, atmospheres, melodies, basslines or comparable content.

“Presets” means sound settings for software synthesizers, effect plugins or comparable music software.

“MIDI Files” means digital note or control data that may be used for music production.

“Project Files” means complete or partial session files from DAWs, such as FL Studio, Ableton Live, Logic Pro, Cubase or comparable formats.

“End Product” means an independent musical work, such as a song, beat, remix, track, jingle, soundtrack, commercial, film, TV, social media or game audio project.

2. Scope of License

With a lawful purchase or download, you receive a simple, non-exclusive, non-transferable and perpetual license to use the included samples, presets and MIDI files within your own music productions and audiovisual works.

The content may be used for both private and commercial projects, including but not limited to:

  • your own songs, beats, tracks and remixes
  • releases on streaming platforms
  • music productions for artists, labels or clients
  • advertising, social media, film, TV, games and online content
  • live performances and DJ sets
  • non-commercial projects, demos and practice productions

No additional license fees or revenue shares are owed for using the content within an independent End Product. In this respect, the content may be used royalty-free.

3. License, No Transfer of Ownership

The content is licensed, not sold.

All copyrights, neighboring rights, ownership rights and other rights in the original content remain with Krach Entertainment GmbH or the respective rights holders.

You only receive the usage rights expressly granted in this Agreement. All rights not expressly granted remain reserved.

4. Permitted Use

You may use, edit, cut, pitch, timestretch, arrange, layer, combine with other sounds and integrate the included samples, presets and MIDI files into your own productions and independent musical works.

Commercial release of your End Product is permitted, provided that the content is not passed on, sold or made accessible in isolation, individually or as a standalone sound source.

Examples of permitted use:

  • A drum loop from the Sample Pack is used in your own track.
  • A vocal chop is edited and included in a song.
  • A preset is used for your own melody.
  • A MIDI file is modified and becomes part of a new production.
  • Several samples are layered and used in a beat.

5. Prohibited Use

The following is not permitted:

  1. Resale or Redistribution
    You may not sell, give away, trade, lend, rent, upload, share or otherwise make the content available to third parties, either in whole or in part.
  2. Upload to Sharing Platforms
    The content may not be distributed on file-sharing websites, torrent platforms, cloud folders, Discord servers, forums, Telegram groups or comparable platforms.
  3. Creation of Competing Products
    You may not use the content to create or distribute your own sample packs, sound packs, preset packs, loop kits, construction kits, plugin libraries, virtual instruments, expansion packs or comparable products.
  4. Isolated Use
    The content may not be released, sold or distributed in isolation or in a nearly unchanged form as individual samples, loops, presets, MIDI files or sounds.
  5. AI Training and Datasets
    The content may not be used to create, improve, train or populate AI models, machine learning systems, sample recognition services, generative music systems or other datasets unless Krach Entertainment GmbH has given express written permission.
  6. Content ID Blocking of Individual Samples
    You may not register individual samples or nearly unchanged content in a way that prevents other lawful licensees from using the same original samples, for example through unjustified Content ID claims.
  7. False Authorship Claims
    You may not claim that you created the original samples, presets or content yourself if they originate from a Sample Pack by Krach Entertainment GmbH.

6. Use of Vocals, Names and Artist Identity

If a Sample Pack contains vocal samples, vocal phrases, artist shouts, producer tags or other voice recordings, these may only be used within your own musical works.

The following is not permitted:

  • using the name “Krach Entertainment GmbH”, “Krach”, “Noiseflow”, “Deutscher Krach” or other associated brand or artist names as a featured artist, producer, composer, singer, co-writer or official contributor
  • creating the impression that Krach Entertainment GmbH or an associated artist contributed to, produced, endorsed or approved your work
  • using names, images, logos, voices, brands or personality rights for promotional purposes without express written permission

Credit is not required unless expressly stated otherwise for the respective product.

7. Project Files and Construction Kits

If a product contains project files, construction kits or complete demo projects, these are primarily intended for analysis, inspiration, education and demonstration.

The musical ideas, arrangements, melodies, chords, drops, song structures or demo compositions contained therein may not be released 1:1 or in a nearly unchanged form as your own work.

Individual samples, presets or MIDI files from such products may only be used under this License if they are expressly included as licensable components of the respective product.

8. No Exclusivity

All content is licensed on a non-exclusive basis.

This means that the same samples, presets or MIDI files may also be used by other customers.

You may not derive any exclusive rights to the original sample from using it within your End Product.

9. User Responsibility

You are solely responsible for ensuring that your End Product does not infringe any third-party rights and that you own or have obtained all further required rights, for example for additional samples, acapellas, remixes, cover versions or trademarks used.

Krach Entertainment GmbH is not responsible for any infringement caused by your own editing, combination, release or other use of the content.

10. Return of Digital Products

Since Sample Packs are digital content, the right of withdrawal may be excluded depending on the purchase process once the download or access has started and you have expressly agreed that the right of withdrawal expires.

The specific rules are set out in the applicable Terms and Conditions and withdrawal policy of Krach Entertainment GmbH or the respective sales platform.

11. Breach of License

In the event of a breach of this License Agreement, Krach Entertainment GmbH may revoke the granted license with immediate effect.

In such a case, you must immediately stop using the content and remove all unlawfully distributed copies. Further legal claims, including claims for injunctive relief, damages and reimbursement of legal costs, remain reserved.

12. Changes to this License

Krach Entertainment GmbH may amend these license terms for future purchases, downloads or product versions.

For products already purchased, the license version valid at the time of purchase or download generally applies, unless otherwise required by law or contract.

13. Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

To the extent legally permissible, the place of jurisdiction shall be the registered office of Krach Entertainment GmbH.
